Terms & Conditions

These Terms & Conditions (the “Terms”) are a binding agreement between you and Mike Verinder (“we,” “us”) and govern your use of the TexasRoam apps for iPhone and iPad and the website and web app at texasroam.com (together, the “Service”). By downloading, signing in to, or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

1. What TexasRoam is

TexasRoam helps you discover and check in to Texas historical sites — markers, cemeteries, courthouses, museums, National Register places, and state historic sites — using data published by the Texas Historical Commission (THC) Atlas and other sources. It is an informational and discovery tool for personal, non-commercial use.

2. Eligibility & your account

You must be old enough to form a binding contract where you live (and at least the minimum age in our Privacy Policy). You sign in with Sign in with Apple; you’re responsible for activity under your account and for keeping your device secure. You can erase your data or delete your account at any time in Profile, as described in the Privacy Policy.

3. Acceptable use

Use the Service lawfully and respectfully. Don’t misuse it, interfere with or disrupt it, attempt to access it in unauthorized ways, scrape or bulk-extract its data, reverse engineer it except where the law expressly permits, or use it to break any law or to enter places you’re not permitted to be.

4. Accuracy of information — not a navigation or safety tool

Site locations, descriptions, inscriptions, directions, and other content may be incomplete, out of date, or inaccurate, and come in part from third-party data we don’t control. TexasRoam is not a navigation, emergency, or safety device. Don’t rely on it for precise routing, road conditions, or whether a place is open, safe, or accessible. Always follow official signage, maps, and local authorities.

5. Assumption of risk — visiting sites

Visiting historical sites is done entirely at your own risk. Many sites are along roadsides, in remote or rural areas, in cemeteries, or on private property, and may be unmarked, unmaintained, hazardous, or closed to the public. You are solely responsible for your own safety and conduct: obey all laws and traffic rules, never interact with the app while driving, respect private property and posted restrictions, and use your own judgment about whether it’s safe to visit a place. You assume all risks of travel to and presence at any site you find through the Service.

6. Intellectual property

The Service — its software, design, text, and graphics — is owned by us or our licensors and protected by law. Underlying historical data is sourced from the THC Atlas and other providers and remains subject to their terms. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use. Apple-related terms also apply (Section 11).

7. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any information in it is accurate or current.

8. Limitation of liability & release

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL MIKE VERINDER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS ARISING FROM YOUR TRAVEL TO OR PRESENCE AT ANY SITE, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US$25.

To the extent permitted by law, you release us from, and agree not to hold us responsible for, any claims, damages, or losses arising out of your use of the Service or your travel to or presence at any site. Because the Service is provided free of charge, this allocation of risk is a basic part of the agreement between us.

9. Your rights that can’t be waived (savings clause)

Some jurisdictions don’t allow the exclusion of certain warranties or the limitation of certain damages. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under the law that applies to you — including, where applicable, liability for death or personal injury caused by our negligence, for fraud, or for breach of mandatory consumer-protection rights. Where a limitation above isn’t enforceable for you, it applies only to the maximum extent the law allows, and the rest of these Terms stay in effect. You may also have statutory consumer rights (for example in the EEA, UK, and elsewhere) that these Terms don’t affect.

10. Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from claims and expenses (including reasonable legal fees) arising out of your misuse of the Service or your violation of these Terms or of any law or third-party right.

11. Apple App Store terms

If you use the app from Apple’s App Store, these Terms are between you and us, not Apple, and Apple is not responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Your use must also comply with the Apple Media Services / App Store Terms of Use.

12. Termination

You can stop using the Service and delete your account at any time. We may suspend or end your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive (including 4–10 and 13) survive termination.

13. Governing law & disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules, and the state and federal courts located in Texas will have jurisdiction — except where the mandatory law of your home country gives you the right to bring proceedings there or requires a different governing law. Please contact us first; most issues can be resolved informally.

14. User-generated content

The Service lets you post content — including ratings, written reviews, comments, photos, and captions — on markers, tours, and trails (“User Content”). You keep ownership of your User Content. By posting it, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, moderate, display, and distribute it within the Service and in connection with operating and promoting the Service. You’re responsible for your User Content, and you represent that you own it or have the rights to post it, that it’s accurate and not misleading, that it doesn’t infringe anyone’s rights or contain private information about other people, and that it complies with these Terms and the law.

Zero tolerance for objectionable content and abusive behavior

There is no tolerance for objectionable content or abusive users on the Service. You may not post, and objectionable content includes, anything that is unlawful, hateful, harassing, threatening, bullying, defamatory, obscene, pornographic or sexually explicit, gratuitously violent, discriminatory, invasive of another person’s privacy, that infringes intellectual-property rights, that impersonates another person, or that is spam, fraudulent, or promotes illegal activity. You also may not harass, threaten, or abuse other users.

By using the Service and posting User Content, you agree to these rules. This section is the end-user license agreement (EULA) governing User Content; if you don’t agree, do not post.

To keep the community safe, we use the following safeguards. All reviews and photos are reviewed before they appear publicly (pre-moderation). You can report any content you find objectionable, and you can block another user so you no longer see their content. We will act on reports of objectionable content and abusive users by removing the content and/or ejecting the user within 24 hours. We may remove any User Content and suspend or terminate any account, at our discretion and without notice, for violating these rules. User Content reflects the views of the people who post it, not us, and we don’t endorse it. To report content or a user, email [email protected].

15. Changes

We may update these Terms; we’ll change the date above and post the new version here. Continuing to use the Service after a change means you accept the updated Terms.
